Terms and Conditions of Service of The Penguin Crew

These Terms and Conditions of Service (hereinafter, the “Terms”) govern access to and use of The Penguin Crew website (hereinafter, the “Website”) and the purchase of products and services offered therein. By accessing and using the Website, you agree to comply fully with these Terms. Please read them carefully before browsing or making a purchase.

2. Purpose

These Terms govern the contractual purchase and sale relationship established between The Penguin Crew and the user at the moment the user accepts the contracting process while browsing the Website and completes the purchase of one or more products.

3. Conditions of Use

The user agrees to make appropriate use of the Website and its content, refraining from engaging in unlawful activities, actions contrary to good faith or public order, or any activity that may damage the physical or logical systems of The Penguin Crew, its suppliers, or third parties. The user shall be liable for any damages or losses arising from improper use of the Website.

4. Purchase Process

To make a purchase, the user must follow the instructions indicated on the Website, select the desired products, and complete the checkout process by making payment. By placing an order, the user confirms that they are authorized to use the selected payment method.

The Penguin Crew reserves the right to modify its commercial offering at any time (including changes to products, prices, promotions, etc.). Such changes shall not affect orders that have already been confirmed.

5. Price and Payment

All prices displayed on the Website include Value Added Tax (VAT), in accordance with applicable Spanish tax regulations. Prices are expressed in euros and do not include shipping costs, which will be clearly specified before completing the purchase.

Payment may be made by credit/debit card, bank transfer, or other methods indicated on the Website. The Penguin Crew uses secure payment platforms to ensure the protection of user data.

6. Delivery

The Penguin Crew ships to Spain and other countries within the European Union. Delivery times will be specified during the checkout process and may vary depending on the destination. Under no circumstances will shipments be made to P.O. boxes.

Delivery times are estimates and, although The Penguin Crew makes every effort to meet them, an exact delivery date cannot be guaranteed. Delivery shall be deemed completed at the time the user receives the product.

7. Right of Withdrawal and Returns

In compliance with the General Law for the Defense of Consumers and Users (Royal Legislative Decree 1/2007 of November 16), the user has the right to withdraw from the purchase within 14 calendar days from receipt of the product, without providing any justification.

To exercise the right of withdrawal, the user must contact The Penguin Crew by email indicating their intention to return the product. Returned products must be in perfect condition and in their original packaging. Return shipping costs shall be borne by the user, unless otherwise stated.

8. Product Warranty

All products sold by The Penguin Crew are covered by a 2-year legal warranty from the date of delivery, in accordance with Royal Legislative Decree 1/2007. If the product has a manufacturing defect, the user may request repair, replacement, a price reduction, or contract termination, as applicable.

9. Data Protection

In compliance with the General Data Protection Regulation (GDPR) and Organic Law 3/2018 on Personal Data Protection and the Guarantee of Digital Rights (LOPDGDD), personal data provided by users will be processed in accordance with The Penguin Crew’s Privacy Policy, available at [link to the Privacy Policy].

10. Modification of the Terms and Conditions

The Penguin Crew reserves the right to modify these Terms and Conditions at any time and without prior notice, in order to adapt to current legislation or for commercial reasons. Any modifications will be published on the Website and will be available for users to review prior to making any purchase.

11. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Spanish law. For the resolution of any disputes that may arise in relation to these Terms, the parties submit to the jurisdiction of the courts and tribunals of the user’s place of residence, provided it is within Spanish territory. If the user resides outside Spain, the parties expressly agree to submit to the courts and tribunals of Catalonia, waiving any other jurisdiction that may apply.
